1. Acceptance of the Terms

By accessing or using the Flowti platform ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access the Service. These terms apply to all users, visitors and anyone who accesses or uses the Service.

2. Description of the Service

Flowti is a SaaS platform that enables businesses and professionals to automate WhatsApp conversations through conversational flows, AI-powered chatbots and WhatsApp Business API integration. The Service includes, among other features:

  • Visual conversational flow builder.
  • AI agents for automated responses.
  • Connection with WhatsApp Business numbers.
  • Analytics and metrics dashboard.
  • Integrations with third-party tools and APIs.

3. Registration and Accounts

  • You must provide truthful, current and complete information during registration.
  • You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

By using Flowti, you agree to:

  • Comply with WhatsApp Business API usage policies and Meta messaging guidelines.
  • Not send spam, unsolicited messages or mass content without prior recipient consent.
  • Not use the platform for illegal, fraudulent or rights-infringing activities.
  • Not attempt to access systems, data or accounts of other users without authorization.
  • Not reverse engineer, decompile or modify Flowti software.
  • Not use the Service AI to generate illegal, misleading, discriminatory or copyright-infringing content.

5. Plans and Payments

  • Plans and pricing are published on our pricing page and may be updated with prior notice.
  • Subscriptions are billed on a recurring basis (monthly, annual or lifetime one-time payment, depending on the selected plan).
  • Payments are non-refundable, except where required by applicable law or as stated in our refund policy.
  • We reserve the right to suspend the service in the event of non-payment after a reasonable grace period.

6. Intellectual Property

Flowti and all of its content, features and functionality (including software, code, designs, texts and interfaces) are the exclusive property of Flowti and are protected by intellectual property laws. Your subscription grants you a limited, non-exclusive and non-transferable license to use the Service in accordance with these terms.

Conversational flows, data and content you create within the platform remain your property. You grant us a limited license to process and store such content exclusively for providing the Service.

7. Artificial Intelligence

  • AI-generated responses are automated and may contain errors. You are responsible for reviewing and supervising automated interactions with your customers.
  • We do not guarantee the accuracy, suitability or legality of responses generated by AI agents.
  • Your conversation data may be used in anonymized and aggregated form to improve our models, unless you opt out of this practice.

8. WhatsApp Business API

The use of WhatsApp Business API through Flowti is subject to the WhatsApp Business Policies and the WhatsApp Terms of Service. Flowti acts as a technical solutions provider and is not responsible for Meta decisions regarding approval, suspension or limitation of WhatsApp Business accounts.

9. Service Availability

We strive to maintain 99.9% availability; however, we do not guarantee uninterrupted service. We may perform scheduled maintenance with prior notice. We will not be liable for interruptions caused by third parties, Meta/WhatsApp infrastructure failures or force majeure events.

10. Limitation of Liability

To the maximum extent permitted by law, Flowti shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data, business opportunities or goodwill, arising from the use of or inability to use the Service. Our total cumulative liability shall not exceed the amount paid by the user during the 12 months preceding the event giving rise to the claim.

11. Cancellation and Termination

  • You may cancel your subscription at any time from your account dashboard. Cancellation becomes effective at the end of the current billing period.
  • After cancellation, your data will be retained for 30 days to allow export. After that period, it will be permanently deleted.
  • We reserve the right to terminate or suspend your access immediately, without prior notice, for any violation of these terms.

12. Modifications

We may modify these Terms of Service at any time. Significant changes will be notified at least 30 days in advance by email or by notice on the platform. Continued use of the Service after the modifications take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction where Flowti has its registered office. Any dispute shall be resolved before the competent courts of that jurisdiction.
